LAW OFFICE OF ANDREA CISNEROS VALDEZ, APC, doing business as ACV Tax Law (“ACV,” “we,” “us” or “our”), is responsible for the personal information described in this notice. Our privacy contact is andrea@cisnerosabogados.com.
This notice applies to information processed through www.acvtaxlaw.com, related correspondence and preliminary inquiries. It is designed first around applicable California privacy requirements, then applicable United States federal requirements, and then requirements applicable in Mexico. That order does not limit any mandatory right granted by applicable law.
2. Notice at collection
The categories below describe information we may collect and the purposes for which we may use it. We do not ask you to provide confidential client information, government identification numbers, account credentials, financial account information or sensitive personal information through this website.
We retain information only as long as reasonably necessary for these purposes, taking into account the nature of the inquiry, conflicts and professional-responsibility requirements, security needs, applicable limitation periods and legal obligations. We do not sell personal information. We do not share personal information for cross-context behavioral advertising.
3. Sources and purposes
We may receive personal information directly from you, automatically from your browser or device, from a person who introduces or refers you, or from public and professional sources when reasonably necessary to evaluate an inquiry or perform a conflicts check.
We use information to respond to communications; evaluate whether the firm may consider an engagement; identify or manage conflicts; operate and secure the website; keep appropriate business, legal and ethical records; comply with law; and establish, exercise or defend legal claims. We will not use collected information for materially unrelated purposes without appropriate notice or consent when required.
4. Disclosures, service providers and transfers
We may disclose information to hosting, security, communications and other technology providers that process it for us; professional advisors subject to appropriate duties; authorities when legally required; and parties involved in a business reorganization or legal claim, subject to applicable safeguards. We may also disclose information at your direction or with your consent.
Website infrastructure and service providers may process information in the United States or other countries. Where Mexican law applies, disclosures to processors acting on our instructions are handled as service-provider processing, and other transfers are made only when permitted by law, required to establish or maintain a legal relationship, or authorized by you as applicable.
5. Cookies, analytics and online tracking
We do not use advertising pixels or behavioral-advertising cookies. Our hosting and security providers may use essential technologies and basic service analytics to deliver the site, count visits, diagnose errors and prevent abuse. Browser settings may allow you to limit cookies, but doing so can affect site operation.
Because we do not use cross-site behavioral advertising, the site does not currently change its practices in response to “Do Not Track” signals. We do not knowingly permit third parties to collect personal information through this site over time and across unaffiliated websites for targeted advertising. Where legally required and technically received, we treat an applicable Global Privacy Control signal as an opt-out request for sale or sharing; our stated practice is not to sell or share such information.
6. California privacy rights
California residents may request information about our privacy practices and correction or deletion of information they submitted, subject to legal and professional obligations. If and to the extent the California Consumer Privacy Act applies to ACV and the information at issue, eligible residents may also have rights to know, access, correct and delete personal information; to opt out of sale or sharing; to limit certain uses of sensitive personal information; and to receive equal service without unlawful discrimination for exercising a right.
We do not sell or share personal information and do not use or disclose sensitive personal information for purposes that require a limitation right. Authorized agents may submit requests as permitted by law. We may need to verify identity and authority before responding. Some information is exempt from these rights, including information protected by attorney-client privilege or other legal exemptions.
7. Rights in Mexico
When Mexico’s Federal Law for the Protection of Personal Data Held by Private Parties applies, you may exercise rights of access, rectification, cancellation and opposition (“ARCO”); revoke consent where the processing is based on consent and revocation is legally available; and request limitations on use or disclosure.
A request should identify the holder, describe the right and the personal data concerned, state the address or means for receiving our response, and include documents reasonably necessary to verify identity or representation. We will respond within the periods and subject to the exceptions established by applicable Mexican law. We do not intentionally collect sensitive, financial or patrimonial data through the website; please do not provide it in a preliminary inquiry.
8. Security and data incidents
We use administrative, technical and organizational safeguards reasonably appropriate to the nature of the information we process. No internet service is completely secure. If a security incident materially affects rights or legally protected interests, we will provide notices required by applicable law.
9. Children
This site is directed to adults and professional audiences. We do not knowingly collect personal information from children under 13 through this website. If you believe a child has provided information, contact us so we can evaluate and delete it as appropriate.
10. No attorney-client relationship
Sending information through the website or corresponding with the firm does not create an attorney-client relationship. Do not assume an unsolicited submission will be treated as confidential, except where applicable law requires otherwise. Do not send sensitive facts or documents before the firm confirms in writing that it can receive them. Any engagement is subject to conflicts review and a written engagement agreement.
11. Requests, questions and changes
To make a privacy request or ask a question, email andrea@cisnerosabogados.com with the subject “Privacy Request.” Please do not include sensitive information in an initial request. We will use the information in the request only to verify, evaluate and respond to it and to retain legally required records.
We may update this notice when our practices or legal obligations change. The current version will remain available on this page with its effective and last-updated dates. If a change materially affects how previously collected information is used, we will provide additional notice when required.
